The 341 Meeting of Creditors
The 341 meeting (named after Section 341 of the Bankruptcy Code) is the one proceeding every debtor must attend. Here is what to expect:
- Timing: 20-40 days after filing. The court sends you notice with the date, time, and location.
- Location: Usually not in a courtroom -- often a conference room at the federal building or courthouse.
- Who is there: The Chapter 7 or Chapter 13 trustee, you, and possibly some creditors (creditors rarely appear in consumer cases).
- What happens: The trustee puts you under oath and asks questions about your petition, schedules, assets, income, and debts. Typical duration: 5-15 minutes.
What to Bring to the 341 Meeting
- Government-issued photo ID (driver's license or passport)
- Proof of Social Security number (SSN card, W-2, or SSA-1099)
- Most recent tax return
- Recent pay stubs (6 months)
- A copy of your filed petition and schedules
Common Trustee Questions
- Did you read your petition before signing it?
- Is everything in your petition true and complete?
- Do you have any assets not listed?
- Have you transferred any property in the past 2 years?
- Do you expect to receive any inheritance, lawsuit settlement, or other future income?
- Have you filed bankruptcy before?
Tip: Answer questions directly and briefly. Do not volunteer extra information. If you do not understand a question, ask the trustee to rephrase it. If you do not know the answer, say "I don't know" rather than guessing.
Court Hearings (If Required)
Not every case requires a court hearing. But if there are objections, motions, or contested matters, you may need to appear before the bankruptcy judge. Tips:
- Dress professionally (business casual at minimum)
- Address the judge as "Your Honor"
- Stand when speaking to the judge
- Bring all relevant documents organized in a binder or folder
- Be on time -- courts run on schedule and your case can be decided in your absence
